Congratulations to KBR attorney Lindsey Nourse on securing dismissal in a medical malpractice matter in Supreme Court, Queens County!

In a recent decision involving COVID-19 immunity, the court granted dismissal, finding our client, the insured, was immune from liability under the EDTPA and PREP Act. Lindsey’s motion persuasively argued that the plaintiff’s care was directly impacted by the insured’s pandemic response and that no evidence supported claims of recklessness.

On May 9, 2025, Governor Kathy Hochul signed a significant amendment to NYLL §191 that limits potential damages for late wage payments.

Previously, employers faced steep penalties, including 100% liquidated damages, for late payments to manual workers, even if wages were ultimately paid. The new amendment narrows that exposure, addressing concerns over disproportionate liability for technical violations.
