Kaufman Borgeest & Ryan LLP attorneys Ari Lessa and Daniel Ishoo secured summary judgment in dental malpractice action involving allegations relating to treatment of 5-implants spanning over a decade.

KBR positioned itself through discovery and depositions to establish that all allegations and claims were time-barred and that the one return visit within the viable time period was merely a consult, with no specific treatment that would allow plaintiff to maintain a cause of action or application of the continuous treatment doctrine.

The Court granted the motion for summary judgment, holding that the continuous treatment doctrine did not apply. All claims against our client were dismissed.
