The case centered on a then 90 year-old resident’s fall which was alleged to have caused a broken wrist and hip, requiring surgical intervention. In our motion for summary judgment, our expert geriatrician conveyed the inevitability of the fall despite frequent monitoring and a comprehensive care plan regimen, while also discrediting the effectiveness of bed alarms and stressing the resident’s rights to privacy. This win is especially noteworthy as a trial date was scheduled for the end of the month.
