Lindsey Nourse and Patrick Dolan successfully demonstrated that all care by the hospital was appropriate and did not cause or contribute to the alleged injuries. It was also successfully established that the hospital was entitled to the protection of the Emergency Disaster Treatment Protection Act (EDTPA). The Court ruled that plaintiff failed to rebut the hospital’s statutory entitlement to dismissal, and confirmed the continued applicability of EDTPA protections afforded to healthcare providers and institutions for claims regarding care rendered during the COVID pandemic. The entire case was dismissed.
