The claims focused on pressure ulcers that Plaintiff developed after sustaining a severe spinal cord injury from several gunshot wounds. The Court was persuaded by KBR’s motion that the standard of care was met and there was no proximate cause for Plaintiff’s alleged injuries. Although Plaintiff presented an expert affirmation in opposition, the Court found that Plaintiff’s expert failed to address any of the defense expert opinions and raise a triable issue of fact. The Court dismissed the case in its entirety. Another great result for our clients!
