Plaintiff alleged that our clients, a Physician Assistant and a Medispa, failed to properly perform and monitor facial laser treatments, lack of informed consent, and fraud allegations. Plaintiff was unable to find an expert to oppose the motion and decided to assert in opposition that the treatment at issue was not medical and instead warranted the application of a negligence standard of care analysis. The court granted summary judgment to the defense and dismissed the plaintiff’s complaint on the grounds that plaintiff’s opposition failed to address both the medical malpractice and negligence claims.
