Plaintiff alleged that our client, a Managed Care Plan, failed to prevent and timely treat plaintiff decedent’s comorbidities over the course of multiple admissions to various hospitals and providers. Rebecca and Jonathan emphasized that our client does not provide medical care or treatment, and all treatment of the decedent’s injuries were a result of the care provided by outside medical facilities. The court granted summary judgment to the defense and dismissed the plaintiff’s motion on grounds that the plaintiff’s expert failed to demonstrate the defendant proximately caused decedent’s injuries and stated his opinions were speculative and conclusory.
