They won a years-long coverage litigation in which the insured (a law firm) sought to compel the payment of defense and expert fees on behalf of the attorney/owner’s construction management company. The appellate court affirmed KBR’s previous victory in the Southern District of New York, finding the insurer had no duty to defend the non-insured construction company, as well as affirming that the construction entity did not render professional services.
