The case involved a slip and fall in the laundry room of a residential building. It was argued that the plaintiff’s own testimony demonstrated that plaintiff made the decision to knowingly walk on a floor that was wet due to a flood, despite being warned of the condition. Our successful argument eliminated any basis for liability in negligence on the part of defendants since the plaintiff’s actions were the sole proximate cause of the accident. The court granted summary judgment, dismissing the complaint in full.
