Plaintiff alleged wrongful death, negligent hiring, and gross negligence, asserting that our client’s negligence led to an 89-year-old resident’s fall and hip fracture. Similar to nursing home lawsuits, the plaintiff claimed our client failed in care planning, medical provision, supervision, and proper discharge. Our motion, supported by a geriatric medicine physician’s expert affirmation, argued that the resident’s needs were adequately met at the adult assisted living facility which by law are prohibited from providing continual nursing care, unlike a nursing or rehab center. Despite opposition from a plaintiff’s expert, the Court granted our Motion, citing the lack of qualifications and unsupported, speculative opinions from the plaintiff’s expert.
