Plaintiff claimed that their client died due to complications from CMV-Colitis, which was not timely diagnosed and/or treated by our clients, the Internist and Nurse Practitioner. The Court was persuaded by Chelsea’s motion that our clients appropriately referred the patient for a colonoscopy and additional testing. In addition, KBR had three expert affidavits in support of the motion. Plaintiff did not oppose our motion, and as a result, the Court granted Summary Judgment in our favor.
