Plaintiff alleged our client, a chiropractor, aggravated a patient’s existing vertebral artery dissection leading to a stroke 2 weeks after treatment. It was claimed our client failed to refer the patient to ER immediately, preventing a timely diagnosis. Ed argued that our client had no reason to suspect a dissection, as the patient’s symptoms resolved within minutes during treatment and were consistent with a typical post-treatment reaction, not a stroke. Therefore, the standard of care did not require immediate referral to the ER, a conclusion the jury affirmed.
