In the Medical Malpractice matter, Lindsey successfully resolved two separate claims against our clients, a medical center and an OB-GYN specialist. The claims focused on the alleged improper placement of a pigtail drain and allegedly failing to diagnose a ruptured appendicitis. As a result of Lindsey’s skillfully written motion, the court granted a dismissal in the case.
In the Long Term Care matter that was initially dismissed due to the lack of capacity, Lindsey successfully argued that the plaintiff was not entitled to CPLR 205(a) due to a misrepresentation in the refiled complaint. She spotted this false representation and quickly moved to dismiss on the basis that the claims were barred by the statute of limitations.
