Kaufman Borgeest & Ryan LLP congratulates Cheyanna Fuchs on securing summary judgment in a case involving allegations that our hospital client caused a Stage IV sacral pressure ulcer, sepsis, and ultimately the patient’s death.
Through experts in geriatrics and critical care, Cheyanna established that the sacral wound was unavoidable due to this patients’ extensive co-morbidities and the need for life-saving critical care. The case involved allegations related to the development and progression of a pressure injury prior to and during the COVID-19 immunity period. The Court accepted Elizabeth’s argument, supported by expert opinion, that the wound was clinically unavoidable.
