<p>Plaintiff alleged multiple departures from the standard of care, including failure to properly evaluate candidacy for a dental implant, inadequate pre-implant imaging and bone grafting, and negligent implant placement. Additional claims centered on the use of an incorrect implant size and failure to diagnose and treat resulting infections. Plaintiff further alleged negligence in connection with efforts to remove a screw that became lodged within the implant during a co-defendant’s restorative efforts, which ultimately required sectioning to allow closure of the mouth and surgical removal of the implant. A replacement implant placed by a subsequent provider also failed, which Plaintiff attempted to attribute to the alleged failures related to the original treatment.<br><br>KBR successfully demonstrated that the care and treatment at issue met the applicable standard and did not proximately cause Plaintiff’s alleged injuries. The Court dismissed all claims.</p>

<p>KBR congratulates Rebecca Rychik on securing two pre-answer dismissals for the same Forensic Psychiatrist, one in the Southern District of New York and the other in New York State court.</p>



<p>Both actions arose from our client’s court-appointed role to evaluate children in custody proceedings. Rebecca successfully argued that quasi-judicial immunity applied and that the complaints failed to state a cause of action, as no physician-patient relationship existed and no duty of care was owed.</p>



<p>In the federal case, the court found there was no subject matter jurisdiction, as the claims were all relating to child custody matters. In the State court matter, the court agreed that the Psychiatrist was protected by the doctrine of quasi-judicial immunity. Additionally,&nbsp; the court found that the plaintiff failed to successfully plead the other causes of action for&nbsp; common law fraudulent misrepresentation and intentional infliction of emotional distress.</p>

<p>KBR congratulates Mario Giannettino and Henry Tilson on securing summary judgment and dismissal in Robertson v. Humboldt House Rehabilitation &amp; Nursing Center, one of the earliest COVID-19 nursing home actions filed in New York State.</p>



<p>The matter presented complex and evolving legal issues, including limited precedent under an unsettled statutory framework, Department of Health scrutiny, infection control findings, extensive discovery, and significant media attention. Given the timing and posture of the case, it carried broader implications within the healthcare defense landscape.</p>



<p>Following five years of litigation and substantial motion practice, the Court granted summary judgement in full, dismissing all claims against the client.</p>
