<p>KBR congratulates Robert Benjamin and Matthew Masi on securing summary judgment in the U.S. District Court for the Middle District of Alabama in a significant case against the Texas Department of Insurance<br><br>The matter addressed the application of the Supremacy Clause of the U.S. Constitution on the Liability Risk Retention Act. <p>In this case, KBR represented a neuroradiologist in a medical malpractice action involving the interpretation of a contrast-enhanced neck MRA.</p>



<p>Plaintiff alleged that our client failed to properly interpret and report the extent of carotid artery stenosis on the study, resulting in the absence of surgical intervention and a subsequent stroke one year later. Claimed injuries included dominant hand weakness, difficulties with word retrieval, and an inability to read more than a few words at a time.</p>



<p>Through live in-court radiologic demonstrations, it was established that the stenosis was properly measured and accurately reported. Through expert testimony, it was demonstrated how the neck MRA interpreted by our client in fact revealed mild stenosis while a neck CTA preformed three days earlier revealed severe stenosis.</p>



<p>The jury returned a verdict in favor of our client within 30 minutes.</p>

<p>Lindsey Nourse and Patrick Dolan successfully demonstrated that all care by the hospital was appropriate and did not cause or contribute to the alleged injuries. It was also successfully established that the hospital was entitled to the protection of the Emergency Disaster Treatment Protection Act (EDTPA). The Court ruled that plaintiff failed to rebut the hospital’s statutory entitlement to dismissal, and confirmed the continued applicability of EDTPA protections afforded to healthcare providers and institutions for claims regarding care rendered during the COVID pandemic. The entire case was dismissed.</p>
