Plaintiff alleged that our client, a healthcare facility, failed to diagnose lung cancer. Dominque submitted three expert affirmations in the fields of oncology, internal medicine, and pathology, as well as a affirmation from a treating physician establishing a prima facie entitlement to summary judgment on both liability and causation. Although the plaintiff presented an expert oncology affirmation, the Court found that the expert’s opinions to be conclusory, speculative and either contradicted or were unsupported by the record.
