Nursing Home Liability

KB&R represents Nursing Homes locally and in addition, supervises the defense of Nursing Homes on a national basis. The Firm utilizes attorneys who have training in the medical sciences as well as an in-house staff of Nurse Consultants to assist in the analysis and defense of these matters. The Firm has an intimate grasp of the regulatory intricacies so interwoven and critical to develop a successful defense or risk management strategy.

On a national level, the Firm has supervisory responsibility in the assignment of local counsel, assists carriers in setting the appropriate reserves, provides counsel to Nursing Home client on matters such as risk assessment and regulatory concerns and also provides advice to carriers on coverage issues. The Firm has considerable experience litigating matters in various regions of the Country and, in particular, has overseen numerous Nursing Home matters in Florida, the recognized hot bed of such litigation, resulting in the successful resolution of many cases. In addition, the Firm routinely engages in the mediation of these matters and, where applicable, has successfully moved for arbitration as a means to promote early resolution and/ or eliminate the risk of an adverse jury verdict.

As counsel to an Insurance Carrier, the Firm has helped write and implement Insurance Policies specific to the Nursing Home Industry and oversees the program on various levels, including an assessment of the applicability of coverage to assuring that a proper and comprehensive defense is offered. In its capacity as counsel to the Insurance Carrier, the Firm also recommends appropriate reserves and provides comprehensive counseling with respect to the applicable statutory mandates impacting the defense and future outlook for these cases.

On a local level, the Firm represents Numerous Nursing homes as attorney of record and in this capacity, engages in all aspects of the defense, through trial. In this regard, Kaufman Borgeest & Ryan LLP has represented numerous nursing homes in New York and New Jersey.
