KB&R’s healthcare practice includes
representation of hospitals, nursing homes,
physicians, home care agencies, ambulatory care
clients, hospices and other healthcare providers,
vendors and suppliers. We are experienced in
transactional, regulatory, corporate and counseling
matters. Some of the areas of expertise include
formation and governance of business entities,
regulatory issues, corporate and governance issues,
contractual matters, HIPAA, employment agreements
and other employment matters (including counseling,
investigations and defense working with the firm’s
employment practices group), managed care issues,
software license and maintenance agreements and
disputes, medical staff affairs (e.g., medical staff
bylaws or provision of a hearing officer for medical
staff hearings), and physician and provider
disciplinary matters. In addition, the firm’s
lawyers are available for risk management and legal
advice often needed by healthcare providers on a 24
hour per day basis, e.g., regarding issues of
consent and confidentiality. The firm’s lawyers have
defended healthcare providers in professional
misconduct and other administrative proceedings, and
have represented both hospitals and physicians in
medical staff proceedings.
KB&R’s healthcare group works closely with the employment
practices group, which represents and counsels employers in all
types of employment-related issues and disputes. Much of our work in
the employment area for healthcare clients involves loss prevention,
including internal investigations, employee and management training
and development of state-of-the-art employment practices, policies
and procedures. The firm enjoys notable success in all variations of
alternative dispute resolution.
KB&R’s directors and officers liability practice also often gets
involved in healthcare issues, given the focus today on the
responsibility of boards. This includes not only defending corporate
directors and officers in all types of liability claims, but
providing risk management services and counseling designed to
minimize liability for board decisions and executive conduct.
